Privacy Policy

1. Introduction

1.1 General. GOWAGO AG, Zurlindenstrasse 134, 8003 Zürich, Switzerland (GOWAGO AG) respects its Users’ privacy. This Privacy Policy explains (i) what information GOWAGO AG collects through the Users’ access and use of the website accessible without limitation at info@gowago.ch, which is a digital car leasing / sale comparison platform, and allows anyone with a single touchpoint to get an overview of (estimated) leasing offers including the GOWAGO AG All-in-one full service leasing product (the Platform) on the market and to receive personalized assistance for a car leasing application, , and any other products and/or services available at the same URL address (together the Services), which are provided by GOWAGO AG; (ii) the use GOWAGO AG makes of such information; and (iii) the security level GOWAGO AG provides for protecting such information.

1.2 Definitions. All other capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Terms of Use accessible at https://www.gowago.ch/en/content/terms-of-use.

1.3 Acceptance. By accessing and/or using the Services, the Users agree to the terms and conditions of this Privacy Policy. and are aware that GOWAGO AG’s policies may change in the future to adapt to future practices, technology or modification in the law.

2. Collected information

2.1 Specific data collected. When Users access and use the Services, GOWAGO AG collects the specific following personal data and information: (i) Full name; (ii) company name, if applicable; (iii) email address; (iv) full address; (v) phone number; (vi) birthdate; (vii) IP address; (viii) visiting date on the Platform; (ix) research criteria of car leasing application; (x) list of the car lease offers viewed on the Platform; (xi) Users’ interaction with the Services such as their navigation details on the Platform, notably without limitation information about Users’ Web browser, webpages Users visited and saved, and log files; and (xii) data collected from third-party plugins/websites such as without limitation Facebook, Google, Euro Tax, car insurance companies, that are provided when Users submit their personal data through the Services.

In order to process a leasing application, a private customer will need to provide the GOWAGO AG with all documents and information necessary for such an application. This includes, but may not be limited to, the following:
Civil status
Nationality (And permit type if you do not hold Swiss citizenship)
Housing situation (together with partner, alone)
Job role
Employer
Employed since?
Income (yearly income divided by 12)
Any open leasings (amount)
Any open credit (amount)
Housing costs
Alimony
Number of children (including their age)
Two-sided readable copy of ID card and/or Passportor, and/or Residence permit.
Copy of the last three months of salary slips

In case of a Business Lease application, collected information include, but may not be limited to, the following:
Name of the company
Name of the signatory
If the company is less than 5 years old, the Business leasing application may need to be supported by a private application, requiring documents cited in the previous section.

2.2 Means of collection. GOWAGO AG collects the Users’ personal data when they access and use the Services, in particular: when Users access and navigate through the Platform; when Users willingly and voluntarily submit personal data through web forms; when Customers submit an inquiry about a car lease offer of his/her interest through third-party plugins/websites and through cookies and other analytics tools.
If the user starts an application, GOWAGO AG requires to collect additional information and documents required by the leasing providers and GOWAGO AG to process the application of a car lease and the GOWAGO AG All-in-one full service leasing product. These may be collected via Email or other ways.

3. Use of collected information

3.1 Required data for performance of Services. The personal data listed in Section 2.1 (i) to (vi), and (ix), are strictly necessary for GOWAGO AG’s core Services, to digitize and comparison car lease offers as well as providing Customers a full overview of real offers on the market and enabling Customers to apply for a leasing online including the GOWAGO AG All-in-one full service leasing product. Users can withdraw at any time their consent for such specific data processing. Please note however that such data processing is strictly necessary to provide the Users the Services and that a withdrawal may lead to the drawback that GOWAGO AG would not be able to provide and perform properly the Services any more. In such a case, GOWAGO AG may terminate the Users’ access and/or use to all or part of the Services without incurring any liability whatsoever.

3.2 Additional purposes of use. In addition, GOWAGO AG collects the personal data listed in Section 2.1 for the following specific purposes:
(i) to provide Users email alerts on car lease offers; (ii) Users’ subscription to GOWAGO AG's newsletter, to provide them further news and updates such as car lease offers matching their interest; (iii) to provide Users with targeted marketing and advertising tailored to their preferences; (iv) to offer Users similar Services; (v) to re-engage Users accessing and using the Services; (vi) to improve the Services; (vii) for cybersecurity of the Services; and (viii) for statistical and planning purposes.
Users can withdraw at any time their consent for the such specific data processing listed in this Section 3.2. In addition, Users have the rights set forth in Section 10 of this Privacy Policy.

4. Third party websites

4.1 Third party websites. The Services may contain links to other websites such as Facebook, Google, Euro Tax, credit scoring companies, car service companies, tire companies, warranty companies or car insurance companies. Please note that this Privacy Policy does not apply to the practices of any company or individual that GOWAGO AG does not control, nor to any websites that may be linked from the Services. Users should carefully review the privacy policies of any websites that they visit from the Services to learn more about their information and privacy practices. The collection and use of the Users’ personal information shall be governed by such other party or website’s privacy policy. GOWAGO AG shall not be held responsible for their privacy practices.

5. Communication to third parties

5.1 Third Parties. GOWAGO AG may in some limited instances communicate the Users’ personal data to specific third parties, on a strict need-to-know basis, to achieve the purposes described in this Privacy Policy:
(i) GOWAGO AG’s personnel; (ii) Sellers, with respect to the Customers and vice versa; (iii) GOWAGO AG’s service providers such as the companies listed under Section 4, in particular for targeted marketing and advertising; (iv) competent courts or supervisory or regulatory bodies, when GOWAGO AG shall compellingly disclose User’s personal data, pursuant to any applicable law, regulation or order, e.g. in case of merger, sale or acquisition, or in case of bankruptcy and liquidation, if applicable; (v) GOWAGO AG’s IT systems providers, cloud service providers, database providers and consultants; (vi) business partners with whom GOWAGO AG conducts business with, which is necessary to offer the Services jointly with GOWAGO AG; (vii) any third party to whom GOWAGO AG assigns or transfers any of GOWAGO AG’s rights or obligations; (viii) Leasing providers to process a leasing application; and (ix) companies directly related to the GOWAGO All in one product in terms of car services, car guarantee, tires and tax authorities (a.o. road traffic office).

5.2 Credit check (CRIF). Users, which apply for a leasing over gowago.ch note, that payment histories (particularly those that concern uncontested demands that remain unpaid after the due date) and any potential debt enforcement information and address details will be passed on to CRIF AG in Zurich, for their legitimate use as a business information agency. CRIF will use the information to check your identity and credit standing, and will disclose it to authorised third parties. The payment histories may be analysed by CRIF on the basis of mathematical/statistical calculation methods to facilitate automated decision-making processes, and particularly to evaluate a person’s credit standing. 6. International transfer

6.1 International transfer. Users’ personal data may be transferred to and maintained on computers located outside of their state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in their jurisdiction. In submitting such personal data, Users specifically agree to that transfer.

7. Cookies and analytics tools

7.1 How to block cookies. GOWAGO AG also uses “cookies” or other analytics tools to collect information. A cookie is a small data file that GOWAGO AG transfers to the Users’ electronic device and is stored on their electronic device. e.g. GOWAGO AG uses cookies or other analytics tools to measure the traffic to and usage of the Services and their different features, and other miscellaneous uses. GOWAGO AG’s Cookies Policy is set forth below.

7.2 Settings configuration. If Users do not wish to have cookies placed on their electronic device, Users should set their browser or electronic device to refuse cookies before using the Services, with the drawback that certain features of the Services may not function properly without the help of cookies.

8. Privacy Policy changes

8.1 Changes. Any future modifications or amendment to this Privacy Policy and/or to the processing of Users’ personal data, as described in this Privacy Policy, will be notified to Users in advance through an individual notice through GOWAGO AG’s usual communication channels (e.g. by email or communication within their Account) as well as through the Platform (via banners, pop-ups or other notification mechanisms).

9. Security

9.1 General. GOWAGO AG always strives to ensure security, integrity and privacy of the Users’ personal data.

9.2 Technical and organizational measures. GOWAGO AG has adopted and implemented technical and organizational measures to avoid unauthorized access or disclosure of any personal data.

10. Users’ rights

10.1 Users’ rights. Users may exercise the following rights under the conditions and within the limits set forth under applicable law:

the right to access their personal data as processed by GOWAGO AG and, if Users believe that any information relating to them is incorrect, obsolete or incomplete, to request its correction or update; the right to request the erasure of their personal data or the restriction thereof to specific categories of processing; the right to object to a channel of communication used for direct marketing purposes; the right (i) to be informed about any decision making, based the fully automated processing of their personal data, (ii) to express their view on such decision and (iii) to require that it be verified by a human being, except if (a) such decision is directly related to the conclusion of an agreement between GOWAGO AG and their request is accepted or (b) if they have given their express consent to such automated decision making; and the right to request their personal data’s portability, i.e. that the personal data Users have provided to GOWAGO AG be returned to the concerned User or transferred to the person of their choice, in a structured, commonly used and machine-readable format without hindrance from GOWAGO AG and subject to their confidentiality obligations.

11. Applicable law and jurisdiction

11.1 Governing Law. This Privacy Policy shall be governed by and construed in accordance with Swiss substantive law, without reference to its conflict of laws provisions.

11.2 Jurisdiction. Any dispute or difference arising out of or in relation to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland, subject to the right of appeal to the Swiss Federal Tribunal.

1. Type of cookies used

1.1 General. GOWAGO AG uses several types of cookies. Some are essential, while others Users can opt out of or block. Opting out or blocking some cookies may affect the functionality of the Services. The below explanations shall help Users to make informed choices about the information they provide to GOWAGO AG when Users access and use the Services, in particular when they visit the Platform.

2. Why and how GOWAGO AG uses cookies

2.1 Purposes of use of cookies. There are broadly four reasons why a cookie might be stored on Users’ electronic device when accessing and using the Services:

6.1 Type of performance cookies. GOWAGO AG uses a number of tools that monitor Users’ use of the Services to help GOWAGO AG improves and customizes the provided information and/or services. In particular the Platform uses the Cookie Google Analytics which collects information and reports website usage statistics without personally identifying individual visitors to Google. Users can opt out of providing GOWAGO AG with this information if they wish, with no impact on their experience of the Platform.
